Putting assets in trust provides for ease of administration after death because there is no need for the probate court to review these arrangements. A trust can either be within a Will (“testamentary trust”) or outside it (for example, a “living trust”). In addition, Maureen is able to build provisions into a trust to meet unusual needs of family members (“special needs trust”). All in all, this is another method for obtaining a high degree of flexibility in your arrangements. After a trust is up and running, Maureen can advise Trustees on the best ways to accomplish the Grantor’s goals and to meet their responsibilities under the Trust and can also represent the interests of beneficiaries.
